Event Liability

Damages which the Event Company or the insured, shall become legally liable to pay upon accidental death, bodily injury or illness of any person due to negligence. This may also extend to cover accidental loss or physical damage to tangible property due to negligence which occurred in the course of or in connection with the Event and due to the Event Organisers negligence.  Physical damage is not automatically included in the policy and must be requested as an extension. It is important to note that this is a legal liability policy and does not cover material damage to property.

Why do I need it and how is it different to Public Liability?

It is now a legal obligation to provide Event Liability cover when staging an event, whether it be for a small crowd at a school gathering, religious events or a large concert at FNB stadium.

To protect your company if an attendee, participant or event personnel institutes legal action against your company following an accident where the outcome may be death, bodily injury or illness due to negligence of the event organiser.  It is also a legal obligation to provide Event Liability cover when Producing an Event, whether it be for a small crowd at a school gathering or a large concert at a stadium.

A Public Liability policy is a standard cover provided for all Property Owners or Tenants and are most often only provided for risks at the noted risk addresses. Some policies provide a “work-away” extension but for a reduced limit. The risk for an Events Organiser is mainly at the location or venue where the event is being hosted!

What is extended cover?

Additional aspects of risks, still associated with the Event liability, which the Insured may opt to take up as an extension to the initial (main) liability policy.

What types of extended cover can I apply for? (Only done in writing)

Emergency medical expenses – on behalf of the underwriter we will pay for the Event Organizer to transport an injured third party to the nearest medical facility. This extended cover pays upon occurrence of an insured risk event and will include medical provisions at the venue. 
Legal defence costs – will cover legal costs that may be insured with the insurers consent.

Collapse or Injury as a result of a Temporary Construction – will provide cover following the Collapse or Injury as a result of a temporary construction. Please note damages to any equipment, stages, tents and the like is not covered under a liability policy as it does not cover material damage.

Food and Drink – Any health conditions directly caused by food or drink at the venue for which the Event organiser could become legally liable to pay to third parties.

Spread of Fire – Any damages or injury at the venue directly related to the spread of fire for which the Event organiser could become legally liable to pay to third parties.

Examples of a claim

Stampede at a music event due to insufficient security due to the negligence of the event organiser.

Equipment falls on a concert-goer and causes injury due to the negligence of the event organiser.

Damage to property by unruly spectators due to the negligence of the event organiser at a sports event.
